Until about thirty years ago, the extent of disclosure about and consent-seeking for medical interventions was influenced by a beneficence model of professional behaviour. Informed consent shifted attention to a duty to respect the autonomy of patients. The new requirement arrived on the American scene in two separate contexts: for daily practice in 1957, and for clinical study in 1966. A confusing double standard has been established. 'Daily consent' is reviewed, if at all, only in retrospect. Doctors are merely exhorted (...) to obtain informed consent; they often minimise uncertainties about 'best' treatment and they feel duty-bound to provide patients with an unequivocal recommendation for action. 'Study consent' in a clinical trial is reviewed prospectively, and doctors are compelled by regulation to point out that there is insufficient evidence to make a rational choice between two compared treatments. It has been impossible to devise informed consent practices that satisfy, in full, the competing moral imperatives of respect for autonomy, concern for beneficence with emphasis on the value of health, and a vigil for justice. A way must be found to experiment with various discretionary approaches that would strike a realistic balance among competing interests. (shrink)

This book brings together essays on themes of human rights and legal history, reflecting the long and distinguished career as academic writer and human rights activist of Brian Simpson. Written by colleagues and friends in the United States and Britain, the essays are intended to reflect Simpson's own legal interests. The collection opens with biography of Simpson's academic life which notes his major contribution to legal thought, and closes with an account of his career in the United States and a (...) bibliography of his writings. As a tribute to Simpson's varied interests in the law, the collection is grouped around themes in human rights, legal philosophy, and legal history. One problem of interpreting research on subconscious processing is the possibility that participants are weakly conscious of the stimuli. Here, we compared the fMRI BOLD response in healthy adults to clearly visible single letters with the response to letters presented in the absence of any behavioural evidence of visibility . No letter catch trials served as a control condition. Forced-choice responses did not differ from chance when letter-to-background contrast was low, whereas they were almost 100% correct when contrast was high. (...) A comparison of fMRI BOLD signals for supraliminal and subliminal letters with the control trials revealed a signal increase in left BA 37 . Comparison of supraliminal with subliminal letters showed a significant increase in the right inferior frontal gyrus . Finally, a comparison of subliminal with supraliminal letters showed increases in the left middle temporal gyrus and the right extrastriate cortex. (shrink)

The American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders (DSM) has for decades been a locus of dispute between ardent defenders of its scientific validity and vociferous critics who charge that it covertly cloaks disputed moral and political judgments in scientific language. This essay explores Alasdair MacIntyre's tripartite typology of moral reasoning—"encyclopedia," "genealogy," and "tradition"—as an analytic lens for appreciation and critique of these debates. The DSM opens itself to corrosive neo-Nietzschean "genealogical" critique, such an analysis holds, only (...) insofar as it is interpreted as a presumptively objective and context-independent encyclopedia free of the contingencies of its originating communities. A MacIntyrean tradition-constituted understanding of the DSM, on the other hand, helpfully allows psychiatric nosology to be understood both as "scientific" and, simultaneously, as inextricable from the political and moral interests—and therefore the moral successes and moral failures—of the psychiatric guild from which it arises. A broad evolutionary perspective is essential to fully reverse figure and ground in the rationality debate. Humans' evolved psychological architecture was designed to produce inferences that were adaptive, not normatively logical. This perspective points to several predictable sources of errors in modern laboratory reasoning tasks, including inherent, systematic biases in information-processing systems explained by Error Management Theory.

Anton Wilhelm Rudolph Amo (1703–c. 1759 ce), philosopher and physician, was born at Axim, Ghana, and died at Fort Chama, Ghana. When he was four years old, the Dutch West Indies Company's preacher in Ghana sent him to Holland to be baptized and educated in the Bible for future service in Ghana. However, the Company headquarters, undesirous of any interference with its lucrative trade in slaves, turned little Amo over to the German Duke Anton Ulric‐Wolfenbuttel.

The additional data, perspectives, questions, and criticisms contributed by the commentaries strengthen our view that local cortical processors coordinate their activity with the context in which it occurs using contextual fields and synchronized population codes. We therefore predict that whereas the specialization of function has been the keynote of this century the coordination of function will be the keynote of the next.

The interpretation of in this context raises some nice problems. It is a term, a very flattering one, which had been appropriated to themselves by a certain class, in many cities at least, and by Dorians in relation to ‘Ionians and islanders’; it had thus become a cant phrase in current usage, the kind of phrase which when used tauntingly, as here, or ironically should be given inverted commas.

In his article ‘A Nonce-word in the Iliad’ Maurice Pope argues against the usual modern interpretation of παναώριος, a Homeric παξ λεγόμενον applied by Achilles to himself at Il. 24.540, sc. ‘of all-untimely fate’, ‘doomed to die young’, and the like. The same is also the interpretation of the scholium παντελς ωρον ποθανούμενον, whilst Herodian and Eustathius, respectively with κατ πάντα ωρον and πάντ ωρον, do no more than paraphrase the force of παν- in the compound. Pope tries to establish (...) instead the suitability of the meaning ‘out of season’, i.e. in what Achilles does or fails to do in general. His case rests on the ground of what is appropriate to or required by the context, since, as he himself shows, the word in itself can, on the analogy of closely related forms, notably the adjective ωρος, bear the meaning usually attributed to it, provided the context contains sufficient indication of a reference to death. Accordingly, the validity of his argument depends on his assessment of this context. Pope recognises that throughout the last part of the Iliad, at least starting from the conversation between Achilles and his mother at 18.70ff., Achilles is fully aware of the nearness and unavoidability of his own death, and that ‘from this point on Homer exploits the atmosphere of impending doom’.
